Je loopt naar een monument en speelt er een schaakpuzzel. Daar is weinig voor nodig, en dat is precies wat we bewaren: een account, een maand van geboorte, en je locatie zolang de app moet weten of je er echt staat.

Wie verantwoordelijk is

Chess Me Outside wordt gemaakt en beheerd door één persoon in Nederland, ingeschreven als eenmanszaak: Chess Me Outside, Schapendreef 455, 3034 ZM Rotterdam, KvK 74982591. Dat is de verwerkingsverantwoordelijke voor alles wat hieronder staat.

Vragen over je gegevens, of een verzoek dat de app zelf niet aankan: privacy@chessmeoutside.com. Je krijgt binnen een maand antwoord.

Wat we van je verwerken

Wat we níet hebben: geen chat, geen vriendenlijst, geen profielen van andere spelers, geen achtergrondlocatie, en geen reclamenetwerk dat meekijkt. Die dingen bestaan niet in de app, dus er valt niets over te verzamelen.

Waarom, en op welke grond

Je account, je factie en je ratings hebben we nodig om het spel te kunnen leveren — dat is de overeenkomst die je met ons aangaat als je een account maakt.

Je geboortemaand vragen we omdat de Nederlandse wet een leeftijdsgrens van 16 stelt voor het zelf geven van toestemming. We bewaren hem om te kunnen laten zien dat we die grens ook echt hanteren.

Locatie: twee dingen, en ze zijn niet hetzelfde. Het ophalen van je positie gebeurt met de toestemming die je aan je telefoon geeft, en die kun je op elk moment weer intrekken in de instellingen van je toestel. Zonder locatie werkt de app gewoon; je kunt alleen geen monument innemen, want daarvoor moet je er staan.

Het controleren van een positie die je al hebt meegestuurd — kijken of de sprong van je vorige punt naar dit punt te maken valt — is iets anders. Dat berust op ons gerechtvaardigd belang: de kaart is gedeeld, en een controle die de gecontroleerde zelf kan uitzetten is geen controle. Voor die controle bewaren we vier afgeronde getallen over hoe zeker je aanwezigheid was. Ze zijn met opzet grof en zijn nooit een coördinaat.

Na het aanmelden sturen we één mail met een bevestigingslink. Dat hoort bij de overeenkomst — een adres waar we je niet kunnen bereiken is geen account waar je ooit weer in komt — en het beschermt de persoon van wie het adres is: tot iemand op die link drukt, is het adres niet vastgelegd. Meldt de echte eigenaar zich daarna aan, dan krijgt die het adres, en het account dat het bezet hield verdwijnt. Heb je zelf ooit een uitdaging gespeeld, dan gebeurt dat nooit.

Voor beveiliging en tegen wachtwoord-raden loggen we verzoeken, met een afgekapt netwerkadres in plaats van je volledige adres.

Tellingen over gebruik en crashes doen we op grond van gerechtvaardigd belang. Je kunt daar bezwaar tegen maken met één schakelaar in Instellingen → Privacy, en dan stopt het tellen overal, niet alleen op deze telefoon.

Standings, ofwel wie waar staat, berusten ook op gerechtvaardigd belang: de kaart is gedeeld, en zonder een bord is er geen zicht op hoe de strijd ervoor staat. Ben je 16 of ouder, dan zet je jezelf met één schakelaar van de tabel af; onder de 16 sta je er nooit op, wat je zelf ook instelt. De app zelf laat je alleen je eigen plek zien, nooit een lijst met andere spelers.

Geen advertenties op basis van jouw gedrag, nooit. Er zit geen advertentie-SDK in de app, er is geen advertentie-ID, en je locatie is nooit een invoer voor welke reclame dan ook.

Als je de game steunt

Neem je een supporter-abonnement, dan verwerken we alleen wat nodig is om te weten dát je er een hebt: dat je abonnee bent en op welk niveau, en de transactienummers die de store ons voor die aankoop geeft. De grond is de overeenkomst — jij vroeg om het abonnement, en dit is wat het leveren ervan vergt.

De betaling loopt volledig via de App Store van Apple of via Google Play. Zij zijn de verkoper, en je kaart- of bankgegevens bereiken ons nooit — we zouden ze niet kunnen zien, ook niet als we wilden. Om te controleren of een abonnement loopt, vragen we de status op bij Apple of Google; daarvoor gaat er een transactienummer naar hen toe. Zij zitten in de Verenigde Staten en zijn daar zelf verantwoordelijk voor die gegevens, niet als partij die voor ons werkt.

Het abonnement bewaren we zolang je account bestaat; het wordt met je account verwijderd en zit in je gegevensdownload. Er staat hier geen prijs of bedrag — het geld is de administratie van de store, niet van ons.

Waarom er geen achtergrondlocatie is

De app vraagt alleen om je locatie terwijl hij open is. Er is geen versie die je op de achtergrond volgt, en die toestemming vragen we ook niet aan.

Dat is een keuze, geen tekortkoming: het spel betaalt voor aankomen, niet voor de weg ernaartoe. Lopen levert niets op, dus er valt niets te meten terwijl je onderweg bent.

Hoe lang we het bewaren

Eén ding is eerlijker om te zeggen dan te verbergen: een losse logregel kunnen we niet op verzoek verwijderen, omdat er geen index bestaat die logregels aan een account koppelt. De korte bewaartermijn is wat daarvoor in de plaats komt.

Met wie we het delen

Met niemand die er iets aan verdient. Je gegevens worden niet verkocht, niet verhuurd en niet aan een advertentienetwerk gegeven.

Wat er wel is, zijn partijen die voor ons werken en niets voor zichzelf met je gegevens mogen doen. Hetzner Online GmbH host de servers, in Falkenstein in Duitsland; het spel zelf — je account, je pogingen, de kaart — staat en blijft daar, back-ups inbegrepen.

Eén ding verlaat de Europese Unie, en dat zeggen we liever precies dan geruststellend. Onze e-mail loopt via Resend, dat in Ierland verstuurt maar als Amerikaans bedrijf zijn eigen verzendlogboek in de Verenigde Staten bewaart: per bericht één e-mailadres en of het is aangekomen, dertig dagen lang. Verder niets — geen locatie, geen geboortemaand, geen rating, geen account-ID. De inhoud van de mail is een link en een termijn.

Mail die jij naar óns stuurt — privacy@, support@, safety@ of locations@ — loopt via Forward Email, een Amerikaans bedrijf met servers in Denver. Hier gaat het wél om de hele inhoud van je bericht, inclusief wat je meestuurt; dat is nu eenmaal wat een e-mail is. Ze bewaren hem niet: hij wordt doorgegeven en is daarna bij hen weg. Uit het spel zelf gaat er niets naartoe — je account, je pogingen en je locatie komen daar nooit.

Apple en Google zien wat er in hun eigen winkel gebeurt — een download, een aankoop — en zijn daarvoor zelf verantwoordelijk.

Kies je ervoor om in te loggen met Apple of Google, dan weten zij dat je hier een account hebt. Ze sturen ons twee dingen terug: een nummer waar wij jou aan herkennen, en een e-mailadres — bij Apple mag dat het doorstuuradres zijn dat ze voor je maken, en dan is het dat wat wij zien. Meer vragen we niet, en je naam, je profielfoto en je contacten komen hier nooit binnen. Doe je het niet, dan hoort geen van beide iets over je account.

Bij een overname of verkoop van Chess Me Outside gaan de accounts mee naar de koper. Dat zeggen we hier omdat het anders niet mag: zonder deze zin zou de app verkocht kunnen worden en de spelersbestanden niet. De koper is aan dit beleid gebonden, en je krijgt bericht voordat het gebeurt.

Als er toch iets uitlekt

Bij een datalek melden we dat binnen 72 uur bij de Autoriteit Persoonsgegevens. Raakt het lek jou en is het risico hoog, dan krijg je zelf bericht: wat er is gebeurd, welke gegevens het betreft, wat wij hebben gedaan en wat jij het beste kunt doen.

Spelers onder de 16

In Nederland mag je vanaf je zestiende zelf toestemming geven voor het verwerken van je gegevens. Ben je jonger, dan moet een ouder of verzorger dat voor je doen.

Ben je 13, 14 of 15, dan vragen we bij het aanmelden om het e-mailadres van je ouder of verzorger. Die krijgt één mail met twee links: ja en nee. Tot ze op ja klikken kun je niet spelen — je kunt wel inloggen, je gegevens opvragen en je account verwijderen.

Onder de 13 kun je geen account maken, ook niet met toestemming. Daar houden we het bij.

Ben je ouder of verzorger en denk je dat je kind hier een account heeft dat jij niet hebt goedgekeurd, mail ons dan op privacy@chessmeoutside.com. Dan verwijderen we het.

Jouw rechten

Het downloadbestand zegt zelf welke stukjes er niet in zitten en waarom. Twee sleutels waarmee je locatie berekend wordt laten we eruit, omdat het teruggeven ervan het spoor zou reconstrueren dat we juist zo kort bewaren.

Verwijderen van je account haalt de kaart niet leeg: een monument dat jij hebt gewonnen houdt zijn kleur en verliest alleen wie hem won.

Is je account geschorst, dan blijven inzage en verwijderen gewoon werken. Een sanctie mag je rechten niet in de weg zitten.

Kom je er met ons niet uit, dan kun je klagen bij de Autoriteit Persoonsgegevens in Den Haag.

Als dit beleid verandert

Dan vragen we het je opnieuw. De app weet welke versie je hebt geaccepteerd, en laat de nieuwe zien voordat je verder speelt.

You walk to a monument and play a chess puzzle there. That does not need much, and not much is what we keep: an account, a month of birth, and your location for as long as the app has to know you are really standing there.

Who is responsible

Chess Me Outside is made and run by one person in the Netherlands, registered as a sole proprietorship: Chess Me Outside, Schapendreef 455, 3034 ZM Rotterdam, the Netherlands, Chamber of Commerce (KvK) number 74982591. That is the data controller for everything below.

Questions about your data, or a request the app itself cannot handle: privacy@chessmeoutside.com. You will get an answer within a month.

What we process

What we do not have: no chat, no friends list, no profiles of other players, no background location, and no ad network watching along. None of that exists in the app, so there is nothing about it to collect.

Why, and on what basis

Your account, your faction and your ratings are what it takes to deliver the game — that is the agreement you enter into when you create an account.

We ask for your month of birth because Dutch law sets 16 as the age at which you can consent for yourself. We keep it so we can show that we actually hold that line.

Location: two things, and they are not the same. Taking your position happens on the permission you give your phone, and you can withdraw that at any time in your device settings. The app still works without location; you just cannot take a monument, because that needs you to be standing at it.

Checking a position you already sent — whether the jump from your last point to this one is one a person could make — is a different matter. That rests on our legitimate interest: the map is shared, and a check the checked person can switch off is not a check. For that check we keep four rounded numbers describing how certain your presence was. They are deliberately coarse and are never a coordinate.

After you sign up we send one email with a confirmation link. That is part of the agreement — an address we cannot reach you at is not an account you will ever get back into — and it protects whoever owns the address: until somebody presses that link, the address is not held. If the real owner signs up afterwards, they get it, and the account that was sitting on it goes. Once you have played a single challenge, that can never happen to you.

For security and against password guessing we log requests, with a truncated network address instead of your full one.

Counts of usage and crashes rest on legitimate interest. You can object with one switch in Settings → Privacy, and the counting then stops everywhere, not just on this phone.

Standings, meaning who stands where, also rest on legitimate interest: the map is shared, and without a board there is no way to see how the contest is going. If you are 16 or older you can take yourself off the table with one switch; under 16 you are never on it, whatever your own setting says. The app itself shows you only your own place, never a list of other players.

No advertising based on your behaviour, ever. There is no ad SDK in the app, no advertising identifier, and your location is never an input to any advertisement.

If you support the game

If you take a supporter subscription, we process only what it takes to know you have one: that you are subscribed and at which tier, and the transaction identifiers the store gives us for that purchase. The basis is the contract — you asked for the subscription, and this is what delivering it needs.

The payment runs entirely through Apple's App Store or Google Play. They are the seller, and your card or bank details never reach us — we could not see them if we wanted to. To confirm a subscription is live we check its status with Apple or Google, which means a store transaction identifier travels to them; they are in the United States, and they are responsible for that data as their own controllers, not as parties working for us.

We keep the entitlement for as long as your account exists, and it is deleted with your account and included when you download your data. There is no price or amount stored here — the money is the store's record, not ours.

Why there is no background location

The app only asks for your location while it is open. There is no version that follows you in the background, and we do not request that permission.

That is a choice rather than a gap: the game pays for arriving, not for the way there. Walking earns nothing, so there is nothing to measure while you are on your way.

How long we keep it

One thing is fairer said than hidden: we cannot delete an individual log line on request, because no index ties log lines to an account. The short retention period is what stands in for that.

Who we share it with

Nobody who makes money from it. Your data is not sold, not rented and not handed to an ad network.

What does exist are parties that work for us and may do nothing of their own with your data. Hetzner Online GmbH hosts the servers, in Falkenstein, Germany; the game itself — your account, your attempts, the map — stays there, backups included.

One thing does leave the European Union, and we would rather say exactly what than say something reassuring. Our email goes through Resend, which sends from Ireland but, being a US company, keeps its own delivery log in the United States: one email address per message and whether it arrived, for thirty days. Nothing else — no location, no birth month, no rating, no account id. The body of the mail is a link and a deadline.

Mail you send us — privacy@, support@, safety@ or locations@ — travels through Forward Email, a US company with servers in Denver. Here it is the whole content of your message, including anything you attach; that is simply what an email is. They do not keep it: it is passed on and then gone from their side. Nothing from the game itself goes there — your account, your attempts and your location never do.

Apple and Google see what happens in their own store — a download, a purchase — and are responsible for that themselves.

If you choose to sign in with Apple or Google, they know you have an account here. They send us two things back: a number we recognise you by, and an email address — with Apple that may be the forwarding address they make for you, and then that is the one we see. We ask for nothing more, and your name, your picture and your contacts never reach us. If you do not use it, neither of them hears anything about your account.

If Chess Me Outside is acquired or sold, the accounts go with it to the buyer. We say so here because otherwise it would not be allowed: without this sentence the app could be sold and the player base could not. The buyer is bound by this policy, and you will be told before it happens.

If something does leak

We report a data breach to the Dutch Data Protection Authority within 72 hours. If the breach affects you and the risk is high, you hear from us directly: what happened, which data it concerns, what we have done, and what you are best off doing.

Players under 16

In the Netherlands you can consent to the processing of your own data from the age of 16. If you are younger, a parent or guardian has to do it for you.

If you are 13, 14 or 15, signing up asks for a parent or guardian's email address. They get one email with two links: yes and no. Until they click yes you cannot play — you can still sign in, get your data and delete your account.

Under 13 you cannot make an account at all, consent or no consent. That is where we stop.

If you are a parent or guardian and think your child has an account here that you did not approve, mail us at privacy@chessmeoutside.com and we will delete it.

Your rights

The download file says for itself which pieces are not in it and why. Two keys used to work out your location are left out, because handing them back would reconstruct the very trace we keep so briefly.

Deleting your account does not empty the map: a monument you won keeps its colour and loses only who won it.

If your account is suspended, access and erasure keep working. A sanction may not stand in the way of your rights.

If we cannot sort it out between us, you can complain to the Autoriteit Persoonsgegevens in The Hague.

If this policy changes

Then we ask you again. The app knows which version you accepted, and shows you the new one before you play on.
